So I bought a Daytona special in Feb. of this year. I decided to to a full on restoration/upgrade. Eventuntually I find a RD400 group on Fbook. So this guy Eric Treve posts a couple of weeks ago he has a DG swingarm for a daytona. I immediately message him to let him know I'm very interested. The guy never posted a price. He made reference that his friend sold one for 1100$. So after a long back and forth he says 1000$. Damn! Ok I'm in. So I try and get this guy to post pics but he keeps posting pics of his other items he wants to sell. I kept saying " I'm only interested in the swingarm".
I'll cut to the chase. This guy had a picture of a bubble wrapped unit that was posted on Fbook. So it shows up at my house friday. It has the exact wrapping in the picture. I open it only to find out it doesn't fit. Its a regular 400 unit. I send him pictures and videos. He then calls me and says that he sent a daytona arm. That he wrapped it right before shipping so my claim is impossible. He then eludes to tell me that Im trying to scam him. Im trying to be patient( because he has my money). He then asks if I'm interested in other parts for the daytona. I reply that lets get past this first.
I was off to take the wife out to dinner so he says he'll call me the next day. He never did. I text him. No reply. I call him; he answers and says can I call you back in an hour? I said yes but call me. He then texts me back and says that I'm trying to scam him and that I'm trying to slander his good name!?!?!? SoTheres more color in this picture but thats the jist of it. So now I paid 1000$ for a beat up rd400 unit!
The cherry on top is...... I purchased a Trac Dynamic swingarm in march and I can't get any response from these guys. I did get lucky one saturday morning. The guy answered the phone; I told him my story. He said They were back ordered 150 units and that they would be shipping out in 2 weeks. that was in may. So now I'm out 1800$ and still have nothing to work with!!!!!!! So if any of you know ERIC TREVE of Lincoln/Pleasantvill Calif. Don't buy anything from the piece of shit!!!! Some people are just fucked up. Small claims court it is.https://www.facebook.com/photo.php?fbid=2418262835094483&set=pcb.10157457139047464&type=3&ifg=1&__tn__=HH-R&eid=ARBVhE3pfpVbaqlOe-hQeBi_1erNoHL31NglwMSDDD_oVIpeNCgls1yz9z6l5rb8V6bgjrZpUjfJLoix
Wow, that really sucks.
That sucks. How did you pay him for the swingarm?
Did DG even make a Daytona swingarm? I've never seen one.
If they did it was probably as bad as the one you've got. (The original DG stuff was/is NOT an upgrade, it's JUNK!).
I have mounted DG swingarms on Daytona bikes. Use the early brake setup and you have to make one new spacer on the brake side(IIRC).
... and on the original DG swing arms the pivot is an imperial size, WTF. I counter bore it and install a metric needle bearing and a torrington.
...oh and just so you know: from a performance point of view a chrome moly (steel)swingarm is a better choice.
YOU WILLING PAID $1000 USD for a DG swingarm? WOW!. The last one I bought was two years ago, I got a swingarm and a pair of DG 400 heads for $750 CDN. (The heads needed to be decked, O ringed, CCed., squished and pinned to make them work).
If you're wanting heads get the SCR ones. They're better.
I've tried talking with that guy and he's a dick. Super selfish in realistic guy showing his shit off and not really selling anything unless it's a super premium price. Post it all up and down Facebook. He's been trying to sell that same stuff for a long time now.
Did you make payment with PayPal?
If so, file a claim.
I hate to bash people, but I will say I've noticed a certain douchy vibe coming from that guy.
It's good to remember to see DETAILED pictures of the actual item before sending that kind of cash over. This can be tough when you're excited about a deal and you're in a community where you can usually trust people. Unfortunately a man's word goes only as far as his integrity.
Yes i paid that much. I did use pay pal and did file a claim. I will be filing a police report tomorrow. The free market can be crazy sometimes. And I've been bit. As far as I know DG did make an arm for a daytona. So It being a rare item I was interested. Wether its a lame upgrade or inferior to steel is subjective that I'm not going to debate. It would have been period correct aftermarket upgrade. I was not looking for heads just the arm. So I've only been back in the 2 stroke seen since february. I've been scouring the internet and rat holing parts for months. I didn't want to do a week by week build post but rather do a write up after the fact.
The very next day I ordered the Trac Dynamics arm I read here on 2 Stroke world of the guy who just received his swingarm after waiting 6 months.WTF!? And now this!!!! Time to powder coat the stock arm!
I was going to order a Trac several months ago glad I didn't now.
What you have is a case of mail fraud. I know, everyone will say there was no postal service contact involved, but the laws (at least when I was involved with them) included telephone calls and I presume they would include texting also. Plus you spoke to him on the phone after the item was delivered to your door.
We were involved in a small business I started to support my racing habit. I was a loss prevention manager for a large catalog distribution center dealing directly with phone and mail customers. We dealt with schemes similar to this all the time; usually involving claims of non-delivery, wrong merchandise, or credit card fraud. In our little business I had one machinist that I sent parts and payment to that failed to deliver the job and return the parts or money; he just strung me along with excuses. After many, many months I got tired of the situation. I wrote the guy a letter, sent it certified, and told him I was applying for an arrest warrant. The next day I went to the Sheriff's Office. The detective took my complaint and said she would apply for an arrest warrant. A couple of days later the detective called to say she reached the fellow by phone and explained she was about to apply for warrant for his arrest for fraud and that while the local police might not treat that as an active matter (because the dollar amount was small) if he were to be stopped for a traffic ticket or when he went to register his car he would likely be arrested and held in jail until the matter could be resolved. I got a money order refund in a few days and my parts back in a week or ten days.
My case was much smaller than yours and I live in a small county in Georgia where people are friendly and helpful. I didn't get any more than the law allowed, but, when I went in I had all my supporting documents, UPS receipts, email copies, copies of telephone records showing when I called him, etc. Plus, it helps to go in in a positive frame of mind and with a good attitude. Don't go in with your ass on your shoulder. If they tell you they can't help you and this is a civil matter just politely say that this fellow has used the phones and mail to defraud you and you want to file a criminal complaint. If that doesn't work call the Magistrate's Office or the Circuit DA. They too are public servants and should be able to help you. (Sometimes overworked police will shift the responsibility to the local where the crime occurred, i.e., his place of residence, in an effort to brush you off. Lean on them because your protection is their responsibility.)

Lyn Garland thats excellent advice. I didn't even think of that angle. It has more teeth. Thanks Z
There's no way PayPal won't refund you. That doesn't mean they will punish the seller, but they likely will by withdrawing the funds from his account without notice.
I won a large $ PayPal claim against BestBuy after they scammed me out of my BestBuy points and charged me for the items I bought with said points. BestBuy was prepared to let me get screwed. PayPal isn't the greatest if you are selling on eBay, otherwise they are as forgiving as any other "bank" or "lender."
And as a side note with PayPal, it is always best to pay the sellers PayPal fees instead of sending friends and family even if ignore means a little more out of your pocket.
Sorry to hear you got burned. That sale seemed too good to be true. Maybe 40 years after the DG swingarms were made somebody's having a sale on them.
sorry to hear man
Sorry to hear Z...hope R&L ships your engine.
It was a lot of work for me and a lot of hard earned $$ for you.
Z's an standup guy!
Chuck
Engine, R&L did I miss something?

Oh, OK separate issue if he is having problem with them too he's on bad luck streak.
I appreciate the comments. Its just amazing the nerve some people to have to fuck someone over without even a second thought. First Trac Dynamics and now a pussy named Eric Treve of Lincoln California. Karma is bitch.
Sorry to hear about your situation. I concur with your karma comment. In Hawaii we call it "bachi" (basically the same as karma). "Bachi is a bitch".
Right on! Bachi is a bitch!!!
I agree with the karma concept but don't forget to utilize the justice system to fight low life scum like this!! He's probably quite skilled at his game and needs to be brought down several notches.
100% Evans Ward. I must have justice.I have the pay pal escalation at this point. He responded to pay pal By flipping the script on me with me saying a I got burned from a prior deal( the Trac Dynamics arm that I still haven't received since March) but used it to build his case. This guy is a thief. I could and should use all my curse words right now but damn; just the freakin nerve of someone some key strokes away?! This ERIC TREVE is just less than a man. Im just venting hard cuz my wife don't hear it.Eating money never goes down well. :taz:
You will eventually get your Trac Dynamics arm. If you're tired of waiting, they will give you a refund. I know they initially quoted me 3 or 4 weeks (which they do everybody) and it finally showed up after 5 months. Call them every week and bug the shit out of them. They told me in one of the many conversations we had, that they won't set up tooling until they have multiple orders. They also said they had a couple people on the list waiting over a year. They offered to refund my PayPal if I was tired of waiting. My bike wasn't down because I was waiting for the arm, so I chose to just wait it out. During my waiting period when I kept calling them for an update, they would always tell me they were working on a new design and it would be worth the wait. I'm glad I waited it out because this is what showed up one day!
Tuck I think you have had better luck than me. I was only able to talk to someone once to date. I still want their product. I just want it yesterday. I will step up my phone calls and bug the shit out of them. I should just make a trip up there. Your giving me hope that was waning. :bang:

That looks way better than they did before.
UPDATE! Justice prevailed! I went through pay pal and filed a dispute. I got my refund!!!!!! It was fairly quick and easy. I was losing hope there for a bit. I also got ahold of Dave at Trac Dynamics......... he told me it would be shipped out by the Nov 19th. Im not holding my breath on that but am going to be all over their ass!!! Oh and this POS Eric Treve called me 4 times last night. I didn't answer do to me not wanting to go off the deep end with would be too easy. Just thought I'de share. :patriot:
Good to hear, keep us posted on Trac Dynamics too.
So for you to get a refund you had to mail the dg arm back correct?
I have the old Trac Dynamics swingarm that you haven't installed yet.
I'll go out to the garage tomorrow and weigh (completely bare) it then post it here.
Yes; I had to return it with proof by way of a tracking# and a signature required. I thought I'de have a harder fight with pp but they were cool;fast and easy to deal with AND made the right decision.

That's why it pays to use paypal. Ebay is really good about refunding you too if you ask. Never hurts to call!
Did Trac Dynamics ship to you yet?
NO! I did call several times over the past few weeks. I was told by Dave to hold on to the phone and he was going to check. He got back on the phone and said it would be made soon and that I would get a confirmation email stating that. I never got an email. So last week I talked to Dave again ; I let him know im tired of these games and would just like to have the product I paid for. He sounded apologetic and acted as if it were the first call. He asked me if i wanted a refund I could or I can stick it out. I chose to hang on a bit longer. I let him know theres a whole community of people that know how they're conducting thier business and know of my situation. He didn't like that. :bang: I also told him if I conducted customer service like he does that I would be out of business. His tone changed and he seem to get the point. he sounded as if he wanted to get several RD swingarms off the books before the end of the year so.................. we'll see. I might just drive up there and in person and rattle some cages. Im tired of dealing with people that lie.
show up its a great motivator. I had an issue with JMC years ago, had a local UK guy ring em up and just threaten to show up, amazing how fast i got my refund after 6 mos of phone and email tag. they went under less than a year later. :twocents:
At this point I'm about to put back the stock arm back on. Its powder coated and ready to go. If I don't get it soon then its a go. :bang:
contact nathan ( retaRD) , he used an sr500 aftermarket one. https://www.motolanna.com/ourshop/prod_448876-Swingarm-Aluminum-Alloy-SuperTuff.html
I actually think its a nicer arm. :twocents:

Unless you are going for an old school aluminum arm look I also think that arm Nathan used looks a lot nicer than most others.
I would like to see some actual weights but I would guess it is a lot lighter than the trac dynamics. The last picture I saw posted of a T/D arm a majority of it was made from solid bar stock with pockets milled out of it.
That MotoLanna 'arm is half the price of the TracDynamics and looks way better
Seems a no-brainer to me.

I've been on their site several times but never seem to find what applies to me. I have a Daytona and was looking for a 1'' over. I don't want to modify anything. Especially dealing with overseas. That rear end above looks perfect.
Well, if you don't wanna mod anything your choices are def limited.

Nice shocks
What did you have to do to make the arm fit beside cutting down the pivot tube?

Ask "retaRD" Nathan.
Those pics are of his bike.
Im not totally opposed to modifying it but its not my first choice. I would first like to see a straight bolt on. The arm has to be closer to what I want first off. They don't have anything close to even start with. Has anyone out out there bought a 1" over arm that they converted to a Daytona?
So I emailed Motolanna and their reply was; " No swingarms for RD" . Yes that was it. So Back to TD for now.
well, not its not for an rd, its for an sr, but can be made to work on an rd. Good luck in the search though.

actually the whole ass end of that bike is to die for
really nice!
PM retaRD for details.
Honestly, I think he's devolved, and now prefers shitty old, slow-ass Harley-Davidsons.
He's in Murvll, TN, Maybe he's ready to sell it?
whoah Jim! thems fighting words. I think hes discovered his love for ZRX's, even bought some Eddie Lawson riding jorts. :nathan:
Since this thread has kind of gone astray anyway... that's an un-cushioned KTM hub and brake nestled in that Motolana swingarm, isn't it friends and neighbors?

I've got nothing but love to give to all :vroom:
... and I'm pretty sure thats a DRZ400 wheel with a KTM rear brake setup.
Garrett, I'm just up the freeway from you in Chehalis...lots of water on the ground here this last weekend!
Jim, I'm sure you're right. I was probably focused on the brake setup.

Did you ever get your Tracdynamic arm?
Yes I did. Ordered in March of 2019 and got it in Jan. of 2020. I sent it to be polished only for me to have to send it back to the polisher because of a shitty job. I had shitty service there the first time I went there and thought " they had to make it right this time" attitude. Naw! I had to send it back. I sent to a place Chip Foose uses for years. Im no ones Foose but man! I'm not going there a third time. Pics and write up soon I hope. 8)
That's what he told me when I called in Dec, if I wanted unpolished could get one January.
